Former Manager Countersued by The Killers
Three years ago The Killers were sued by their former manager, Braden Merrick, for a supposed breach of contract. Currently the band is responding with a countersuit that claims Merrick was an incompetent and double-dealing manager, resulting in a loss of income for the foursome.
The new suit was filed last Friday in a Las Vegas federal court – The Killers are claiming breach of fiduciary duty, unjust enrichment, and breach of contract. Oh, and a breach of implied good faith by both Merrick and his management company, From the Future.
Essentially it seems The Killers are suing over missed money-making opportunities; the suit cites “multi-million-dollar damages in missed concerts and lost touring revenues, and via the bungling of merchandising and promotional opportunities.” The lawsuit also claims that Merrick was basically incompetent even with the most basic aspects of his job – he seemed to have trouble obtaining proper touring visas and organizing promotions and international tours.
Merrick is also being sued for working as a paid Island Def Jam consultant without The Killers’ knowledge.
Back in ’06, Merrick sued The Killers as well as their new manager, Robert Reynolds, for about $16 million apiece. The California Labor Commission eventually ruled that Merrick had violated the law in seven instances by not having the required talent agent’s license when he was working for the band.
No final rulings on Merrick’s lawsuit have been reached, and the stay that was placed on the case while The Killers took their complaints to the Labor Commission has since been lifted.
